    Social Media Terms & Conditions - The German Christmas Shop

    Current from 1 July 2021

    1. By entering the promotion, entrants confirm that they have read and agree to be bound by these terms and conditions and all rules and guidelines applicable to the use of Facebook, Instagram or Pinterest (as applicable).
    2. The Promoter of this prize draw is The German Christmas Shop.
    3. 'Social Media competitions' relate to competitions promoted via Facebook, Instagram or Pinterest.
    4. All competitions posted on social media channels will be classified as 'games of skill' requiring entrants to add a comment or submit a photo or video.
    5. Winners will be assessed based upon the quality of their entry. This is to ensure that we comply with all relevant State and Territory regulations regarding competitions.
    6. We DO NOT select competition winners at random as this requires additional government licenses and fees. 
    7. Competition Winners will be decided at the sole discretion of The German Christmas Shop.
    8. You agree to be bound by the decisions of the Promoter, which are final in all matters relating to the promotion. No correspondence will be entered into in respect of the Promoter’s decisions
    9. Through Social Media promotions, we offer entrants a chance to win items from our range of handcrafted Christmas decorations, or gift vouchers for use on our online store.
    10. To enter a nominated prize draw, entrants must add a comment, photo or video to the social media channel specified within the Competition details. It is this post that will be decided on as part of the 'Game of Skill'
    11. Entrants are encouraged to like and share posts also.
    12. Entrants must be Australian residents, aged 18 years or over.
    13. One entry allowed per person. Entries submitted on behalf of another person will not be accepted and joint submissions are not allowed.
    14. No purchase is necessary to enter this promotion however internet access is required.
    15. Promotions will clearly stipulate an end date and time by which 'Entries' must be added. Entries after this date and time will not be accepted.
    16. Promotions will stipulate the number and type of prize on offer. All prizes are non-refundable, non-transferable and non-exchangeable and there is no cash alternative offered.
    17. Winners will be decided from all valid entries received once the end date of the promotion has been reached.
    18. Winner’s Social Media account names will be published on the German Christmas Shop Facebook/Instagram/Pinterest page as part of the announcement.
    19. Each winner will be notified within five working days of the draw via direct message to the account from which the entry was made and will be asked to provide their full name and address. If a winner fails to respond within five working days of this notification, a redraw will take place from the remaining valid entries to select a new winner. If any winner declines a prize or fails to respond within the required period, they forfeit any right to the prize.
    20. The prize will be sent to the address supplied within two weeks of notification.
    21. Winners may be required to submit valid identification before receiving their prize.
    22. All copyright in the entries is the property of the German Christmas Shop. We reserve the right to use any entries for promotional activities including additional social media and email marketing content and no additional payment will be made for using entries in this way.
    23. The Promoter does not accept responsibility for network, computer or software failures of any kind and has no responsibility for lost, delayed or misdirected entries.
    24. The Promoter reserves the right to discount any inappropriate or offensive entries and to disqualify any entries if the Promoter, at its sole discretion, believes that there has been an attempt to manipulate or tamper with the operation of the promotion (including, without limitation, by setting up multiple Instagram, Facebook or other social media accounts in order to submit multiple entries).
    25. The Promoter does not accept any responsibility for any infringement of any third party intellectual property rights caused by entrants entering this prize draw.
    26. Except for the purpose of carrying out the promotion, contacting winners and sending out prizes we will not use entrants’ personal data without the express consent of the entrant.
    27. These terms and conditions shall be governed by and construed exclusively in accordance with Australian Law and parties agree to submit to the exclusive jurisdiction of Australian Courts, including the seeking of all injunctive or ancillary relief actions.
    28. By entering and participating, entrant agrees to hold harmless, defend and indemnify Facebook from and against any and all claims, demands, liability, damages or causes of action (however named or described), losses, costs or expenses, with respect to or arising out of the promotion
